A University lecturer at the faculty of law, Adekunle Ajasin University Akungba-Akoko, Ondo State and author of the 4th Edition of Sample Drafts for Lawyers which was presented to memebrs of the public on 19th April, 2019 at Fingerprint Hotel, Akure in Ondo State has said that government of states loses a lot of hundreds of millions of Naira that could have been generated as property tax to individuals and corporate organisations due to lack of proper legal documentation of land transactions.

According to him, many of the property transactions, whether customary land or statutory properties, are evidenced by mere receipts or in some cases, simple agreements and most of them are not properly executed and perfected according to law. For example, you cannot process and obtain your Certificate of Occupancy (CofO) without your title deed and your title deed is more important than CofO in proofing a good root of title except where it is a state grant.

He however, mentioned that Legal practitioners should show competence and dedication and devotion to their Clients’ peculiar interest and agreements whenever they prepare legal documents rather than adopting precedents forms without necessary modifications. Legal practitioners must avoid the use of archaic and verbose words of the old days and adopt modern simple expression in their drafting. According to him, many of the precedent book used in Law Offices are foreign and irrelevant to Nigerian Legal System and legal practice. He also advised legal practitioners to avoid being sued for professional misconduct especially by their educated clients as a result of this. He also warn pirates and booksellers to desist from acts of illegality, unathorised duplication and sales of authors’ work as more strategic security surveillance is in place to apprehend and prosecute culprits.
